A Cardinal writes to his brother

This morning in Rome, the Prefect of the Congregation for Bishops, His Eminence, Marc Ouellet published the text of an open letter which he has addressed to His Excellency, Carlo Maria Vigano, former Apostolic Nuncio to the United States of America.

concerning recent allegations against the Holy See

Dear brother Carlo Maria Viganò,

In your last message to the press, in which you make accusations against Pope Francis and against the Roman Curia, you invite me to tell the truth about certain facts that you interpret as signs of an endemic corruption that has infiltrated the hierarchy of the Church up to its highest levels. With pontifical permission, and in my capacity as Prefect of the Congregation for Bishops, I offer my testimony about matters concerning the Archbishop emeritus of Washington, Theodore McCarrick, and his presumed links to Pope Francis, matters that are at the centre of your public accusations and your demand that the Holy Father resign. I write my testimony based on my personal contacts and on documents in the archives of the Congregation, currently the object of study to clarify this sad case.

Out of consideration for the good, collaborative relationship we had when you were Apostolic Nuncio in Washington, allow me to say, in all honesty, that I find your current attitude incomprehensible and extremely troubling, not only because of the confusion it sows among the People of God, but because your public accusations gravely harm the reputation of the bishops, successors of the Apostles. I recall a time when I enjoyed your esteem and your trust, but now I see that I have been stripped in your eyes of the respect that was accorded to me, merely for the reason that I have remained faithful to the Holy Father’s guidance in exercising the service he has entrusted to me in the Church. Is not communion with the Successor of Peter an expression of our obedience to Christ who chose him and sustains him with his grace? My interpretation of Amoris Laetitia, which you criticize, is grounded in this fidelity to the living tradition, which Francis has given us another example of by recently modifying the Catechism of the Catholic Church on the question of the death penalty.

Let us address the facts. You said that on June 23, 2013, you provided Pope Francis with information about McCarrick in an audience he granted to you, as he also did for many pontifical representatives with whom he met for the first time that day. I can only imagine the amount of verbal and written information that was provided to the Holy Father on that occasion about so many persons and situations. I strongly doubt that the Pope had such interest in McCarrick, as you would like us to believe, given the fact that by then he was an 82-year-old Archbishop emeritus who had been without a role for seven years. Moreover, the written instructions given to you by the Congregation for Bishops at the beginning of your mission in 2001 did not say anything about McCarrick, except for what I mentioned to you verbally about his situation as Bishop emeritus and certain conditions and restrictions that he had to follow on account of some rumours about his past conduct.

From 30 June 2010, when I became Prefect of the Congregation for Bishops, I never presented in audience the McCarrick case to Pope Benedict XVI or to Pope Francis – not until recently, after his dismissal from the College of Cardinals. The former Cardinal, retired in May of 2006, had been requested not to travel or to make public appearances, in order to avoid new rumours about him. It is false, therefore, to present those measures as sanctions formally imposed by Pope Benedict XVI and then invalidated by Pope Francis. After a review of the archives, I find that there are no documents signed by either Pope in this regard, and there are no audience notes from my predecessor, Cardinal Giovanni-Battista Re, imposing on the retired Archbishop the obligation to lead a quiet and private life with the weight normally reserved to canonical penalties. The reason is that back then, unlike today, there was not sufficient proof of his alleged culpability. Thus, the Congregation’s decision was inspired by prudence, and the letters from my predecessor and my own letters urged him, first through the Apostolic Nuncio Pietro Sambi and then through you, to lead a life of prayer and penance, for his own good and for the good of the Church. His case would have deserved new disciplinary measures if the Nunciature in Washington, or any other source, had provided us recent and definitive information about his behaviour. I am of the opinion that, out of respect for the victims and given the need for justice, the inquiry currently underway in the United States and in the Roman Curia should provide a comprehensive and critical study of the procedures and the circumstances of this painful case in order to prevent something like it from ever happening in the future.

How is it possible that this man of the Church, whose incoherence has now been revealed, was promoted many times, and was nominated to such a high position as Archbishop of Washington and Cardinal? I am personally very surprised, and I recognize that there were failures in the selection procedures implemented in his case. However, and without entering here into details, it must be understood that the decisions made by the Supreme Pontiff are based on the information available to him at the time and that they are the object of a prudential judgment which is not infallible. I think it is unjust to reach the conclusion that there is corruption on the part of the persons entrusted with this previous discernment process, even though in the particular case some of the concerns that were raised by testimonies should have been examined more closely. The Archbishop also knew how to cleverly defend himself from those concerns raised about him. Furthermore, the fact that there could be in the Vatican persons who practice or support sexual behaviour that is contrary to the values of the Gospel, does not authorize us to make generalizations or to declare unworthy and complicit this or that individual, including the Holy Father himself. Should not ministers of the truth avoid calumny and defamation above all?

Dear pontifical representative emeritus, I tell you frankly that to accuse Pope Francis of having covered-up knowingly the case of an alleged sexual predator and, therefore, of being an accomplice to the corruption that afflicts the Church, to the point that he could no longer continue to carry out his reform as the first shepherd of the Church, appears to me from all viewpoints unbelievable and without any foundation. I cannot understand how you could have allowed yourself to be convinced of this monstrous and unsubstantiated accusation. Francis had nothing to do with McCarrick’s promotions to New York, Metuchen, Newark and Washington. He stripped him of his Cardinal’s dignity as soon as there was a credible accusation of abuse of a minor. For a Pope who does not hide the trust that he places in certain prelates, I never heard him refer to this so called great advisor to the pontificate for episcopal appointments in the United States. I can only surmise that some of those prelates are not of your preference or the preference of your friends who support your interpretation of matters. I think it is abhorrent, however, for you to use the clamorous sexual abuse scandal in the United States to inflict an unmerited and unheard of blow to the moral authority of your superior, the Supreme Pontiff.

I have the privilege of having long meetings with Pope Francis every week to discuss the appointment of bishops and the problems that affect their governance. I know very well how he treats persons and problems: with great charity, mercy, attentiveness and seriousness, as you too have experienced. I think it is too sarcastic, even blasphemous, how you end your last message, purportedly appealing to spirituality while mocking the Holy Father and casting doubt about his faith. That cannot come from the Spirit of God.

Dear brother, how much I wish that I could help you return to communion with him who is the visible guarantor of communion in the Catholic Church. I understand that deceptions and sufferings have marked your path in the service to the Holy See, but you should not finish your priestly life involved in an open and scandalous rebellion that inflicts a very painful wound to the Bride of Christ, whom you pretend to serve better, while causing further division and confusion among the People of God. How could I answer your call except by saying: stop living clandestinely, repent of your rebelliousness, and come back to better feelings towards the Holy Father, instead of fostering hostility against him. How can you celebrate Mass and mention his name in the Eucharistic Prayer? How can you pray the Holy Rosary, or pray to Saint Michael the Archangel, or to the Mother of God, while condemning the one Our Lady protects and accompanies every day in his burdensome and courageous mission?

If the Pope was not a man of prayer; if he was attached to money; if he favoured riches to the detriment of the poor; if he did not demonstrate a tireless energy to welcome all miseries and to address them through the generous comfort of his words and actions; if he did not seek to implement all possible means to announce and to communicate the joy of the Gospel to all in the Church and beyond her visible horizons; if he did not lend a hand to the families, to the abandoned elderly, to the sick in body and soul and, above all, to the youth in their search for happiness; one could prefer someone else, according to you, with a different political or diplomatic approach. But I cannot call into question his personal integrity, his consecration to the mission and, above all, the charisma and peace he enjoys through the grace of God and the strength of the Risen One.

Dear Viganò, in response to your unjust and unjustified attack, I can only conclude that the accusation is a political plot that lacks any real basis that could incriminate the Pope and that profoundly harms the communion of the Church. May God allow a prompt reparation of this flagrant injustice so that Pope Francis can continue to be recognized for who he is: a true shepherd, a resolute and compassionate father, a prophetic grace for the Church and for the world. May the Holy Father carry on, full of confidence and joy, the missionary reform he has begun, comforted by the prayers of the people of God and the renewed solidarity of the whole Church, together with Mary, Queen of the Holy Rosary!

Cher confrère Carlo Maria Vigano,

Dans ton dernier message aux Media pour dénoncer le Pape François et la Curie romaine, tu
m’exhortes à dire la vérité sur des faits que tu interprètes comme une corruption endémique qui a envahi la hiérarchie de l’Église jusqu’à son plus haut niveau. Avec la permission pontificale requise, j’offre ici mon témoignage personnel comme préfet de la Congrégation pour les Évêques, sur les faits concernant l’Archevêque émérite de Washington Theodore McCarrick et sur ses liens présumés avec le Pape François, qui font l’objet de ta dénonciation publique retentissante, ainsi que de ton exigence de démission à l’égard du Saint Père. Mon témoignage s’appuie sur mes contacts personnels et sur les documents d’archive de la Congrégation qui font actuellement l’objet d’une étude pour éclairer ce triste cas.

Permets-moi toutefois de te dire d’abord en toute sincérité, à cause de la bonne collaboration qui a existé entre nous quand tu étais nonce à Washington, que ta position actuelle m’apparaît
incompréhensible et extrêmement regrettable, non seulement à cause de la confusion qu’elle sème dans le peuple de Dieu, mais à cause des accusations publiques qui lèsent gravement la réputation des évêques, successeurs des Apôtres. Je me souviens d’avoir joui un certain temps de ton estime et de ta confiance, et je constate que j’aurais maintenant perdu à tes yeux la dignité qui m’était reconnue, pour la seule raison que je suis resté fidèle aux orientations du Saint Père dans le service qu’il me confie dans l’Église. La communion avec le Successeur de Pierre n’est-elle pas l’expression de notre obéissance au Christ qui l’a choisi et qui le soutient de sa grâce? Mon interprétation d’Amoris Laetitia que tu dénonces, s’inscrit dans cette fidélité à la tradition vivante dont François nous a donné un autre exemple en modifiant récemment le Catéchisme de l’Église Catholique sur la question de la peine de mort.

Venons-en aux faits. Tu dis avoir informé le Pape François le 23 juin 2013 sur le cas McCarrick
lors de l’audience qu’il t’a concédée, de même qu’à tant d’autres représentants pontificaux qu’il a rencontrés alors pour la première fois. J’imagine la quantité énorme d’informations verbales ou écrites qu’il a dû alors recueillir sur beaucoup de personnes et de situations. Je doute fort que McCarrick l’intéressait au point où tu voudrais le faire croire, puisqu’il était un Archevêque émérite de 82 ans et sans office depuis sept ans. C’est pourquoi les instructions écrites de la Congrégation qui t’ont été données au début de ta mission à Washington en novembre 2011, ne disaient rien de McCarrick, si ce n’est que, oralement, je t’ai informé de sa situation comme évêque émérite devant obéir à certaines conditions et restrictions à cause des rumeurs sur son comportement dans le passé.

Depuis le 30 juin 2010 que je suis préfet de cette Congrégation, je n’ai jamais porté en audience auprès du pape Benoit XVI ou du pape François le cas McCarrick, sauf ces jours derniers après sa déchéance du Collège des Cardinaux. L’ex-cardinal, retraité en mai 2006, était exhorté à ne pas voyager et à ne pas faire d’apparitions publiques afin de ne pas provoquer d’autres rumeurs qui circulaient à son sujet. Il est faux de présenter les mesures prises à son égard comme des « sanctions » décrétées par le Pape Benoît XVI et annulées par le Pape François. Après révision des archives, je constate qu’il n’y a pas de documents à ce sujet signés par l’un ou l’autre pape, ni de note d’audience de mon prédécesseur le Cardinal Jean-Baptiste Re, qui donnerait le mandat d’obliger l’Archevêque émérite McCarrick au silence et à la vie privée avec la rigueur de peines canoniques. La raison en est qu’on ne disposait pas alors, à la différence d’aujourd’hui, de preuves suffisantes de sa culpabilité présumée. D’où la position de la Congrégation, inspirée à la prudence, et les lettres de mon prédécesseur et de moi-même l’exhortant, par l’intermédiaire des Nonces Apostoliques Pietro Sambi et toi-même, à un style de vie discret de prière et pénitence pour son propre bien et celui de l’Église. Son cas aurait fait l’objet de nouvelles mesures disciplinaires si la Nonciature à Washington ou une quelconque autre source nous avait fourni des informations récentes et décisives sur son comportement. Je suis d’avis que, par respect des victimes et exigence de justice, la recherche en cours aux États-Unis et à la Curie romaine fournisse une analyse critique complète des procédures et des circonstances de ce cas douloureux afin d’éviter que cela se reproduise dans l’avenir.

Comment se fait-il que cet homme d’Église dont on connaît aujourd’hui l’incohérence, ait été
promu à plusieurs reprises jusqu’à occuper les très hautes fonctions d’Archevêque de Washington et de Cardinal ? J’en suis moi-même fort étonné, et je reconnais des failles dans le processus de sélection qui a été mené dans son cas. Mais sans fournir ici de détails, on doit comprendre que les décisions qui sont prises par le Souverain Pontife reposent sur les informations dont on dispose au moment précis, et qui font l’objet d’un jugement prudentiel qui n’est pas infaillible. Il me semble injuste de conclure à la corruption des personnes en charge du discernement préalable même si, dans le cas concret, certains indices fournis par des témoignages auraient dû être davantage examinés. Le prélat en cause a su se défendre très habilement des doutes soulevés à son endroit. Par ailleurs, qu’il puisse y avoir au Vatican des personnes qui pratiquent et soutiennent des comportements contraires aux valeurs de l’Évangile en matière de sexualité, ne nous autorise pas à généraliser et à déclarer indignes et complices un tel et un tel, et même le Saint Père lui-même. Ne faut-il pas que les ministres de la vérité se gardent avant tout de la calomnie et de la diffamation ?

Cher représentant pontifical émérite, je te dis franchement qu’accuser le pape François d’avoir
couvert en toute connaissance de cause ce présumé prédateur sexuel, et donc d’être complice de la corruption qui sévit dans l’Église au point d’être devenu indigne de poursuivre sa réforme en tant que premier pasteur de l’Église, me semble à tous les points de vue incroyable et invraisemblable. Je n’arrive pas à comprendre comment tu as pu te laisser convaincre de cette monstrueuse accusation qui ne tient pas la route. François n’a eu rien à voir avec les promotions de McCarrick à New York, Metuchen, Newark et Washington. Il l’a destitué de sa dignité de cardinal dès qu’est apparue une accusation crédible d’abus de mineur. Je ne l’ai jamais entendu faire allusion à ce soi-disant grand conseiller de son pontificat pour les nominations en Amérique, alors que le Pape ne cache pas la confiance qu’il accorde à certains prélats. Je devine que ceux-ci ne sont pas de ta préférence ni de celle des amis qui soutiennent ton interprétation des faits. Mais je trouve aberrant que tu profites du scandale retentissant des abus sexuels aux États-Unis pour infliger à l’autorité morale de ton supérieur, le Souverain Pontife, un coup inouï et immérité !

J’ai le privilège de rencontrer longuement le pape François chaque semaine pour traiter les
nominations d’évêques et les problèmes qui affectent leur gouvernement. Je sais très bien comment il traite les personnes et les problèmes, avec beaucoup de charité, de miséricorde, d’attention et de sérieux, comme tu en as fait toi-même l’expérience. De lire comment tu termines ton dernier message apparemment très spirituel en te moquant et en jetant un doute sur sa foi m’a semblé vraiment trop sarcastique, voire blasphématoire. Cela ne peut pas venir de l’Esprit de Dieu.

Cher confrère, je voudrais bien t’aider à retrouver la communion avec celui qui est le garant
visible de la communion de l’Église catholique ; je comprends que des peines et des déceptions aient jalonné ta route au service du Saint Siège, mais tu ne peux pas terminer ainsi ta vie sacerdotale dans une rébellion ouverte et scandaleuse qui inflige une blessure très douloureuse à l’Épouse du Christ, que tu prétends mieux servir, en aggravant la division et le désarroi dans le peuple de Dieu. Que puis-je répondre à ton appel sinon te dire : sors de ta clandestinité, repens-toi de ta révolte et reviens à de meilleurs sentiments à l’égard du Saint Père au lieu de fomenter l’hostilité contre lui. Comment peux-tu célébrer l’Eucharistie et prononcer son nom au canon de la messe? Comment peux-tu prier le saint Rosaire, Saint Michel Archange et la Mère de Dieu en condamnant celui qu’elle protège et accompagne tous les jours dans son lourd et courageux ministère ?

Si le Pape n’était pas un homme de prière, s’il était attaché à l’argent, s’il favorisait les riches aux dépens des pauvres, s’il ne démontrait pas une énergie infatigable pour accueillir toutes les misères et donner le généreux réconfort de sa parole et de ses gestes, s’il ne multipliait pas tous les moyens possibles d’annoncer et de communiquer la joie de l’évangile à tous et à toutes, dans l’Église et au-delà de ses frontières visibles, s’il ne tendait pas la main aux familles, aux vieillards abandonnés, aux malades de l’âme et du corps, et surtout aux jeunes en recherche de bonheur, on pourrait peut-être lui préférer, selon toi, quelqu’un qui adopte d’autres attitudes diplomatiques et politiques, mais je ne peux pas mettre en cause son intégrité personnelle, sa consécration à la mission et surtout le charisme et la paix qui l’habitent, par la grâce de Dieu et la puissance du Ressuscité.

En réponse à ton attaque injuste et injustifiée dans les faits, cher Vigano, je conclus donc que
l’accusation est un montage politique privé de fondement réel incriminant le pape, et qu’elle blesse profondément la communion de l’Église. Plût à Dieu que cette injustice flagrante soit rapidement réparée et que le Pape François continue à être reconnu pour ce qu’il est : un pasteur insigne, un père compatissant et ferme, une grâce prophétique pour l’Église et pour le monde. Qu’il poursuive joyeusement et en toute confiance la réforme missionnaire qu’il a entreprise, en sachant qu’il peut compter encore davantage sur la prière du peuple de Dieu et la solidarité renouvelée de toute l’Église unie à Très Sainte Vierge Marie, Reine du Saint Rosaire!
